Minneapolis Homicide Attorney

Have you been charged with the crime of murder or manslaughter?

Homicide is defined as the killing of one person by another.  Some people use the word homicide interchangeably with the word murder, which is technically incorrect.  When someone is accused of committing homicide, they may be charged with murder or manslaughter.  Murder is the intentional killing of another, and manslaughter is the unintentional killing of another.

The crime of murder is divided into 2 degrees of significance:

Murder in the First Degree:  The killing of another person with purpose and premeditation.  Additionally, it includes the unlawful killing of a peace officer or a minor, as well as the unlawful killing of another during the commission of certain serious felony crimes.

Murder in the Second Degree:  The killing of another committed without premeditation, or that occurred "in the heat of passion".

Manslaughter is either voluntary or involuntary:

Voluntary Manslaughter:  The unintentional killing of another without prior intent to kill.  The circumstances surrounding the killing caused the person to become severely emotionally or mentally disturbed.

Involuntary Manslaughter:  The unintentional killing of another person, usually caused by recklessness, criminal negligence or a low-level felony.
