It is a crime for a person under the age of 21 years to drive, operate, or be in physical control of a motor vehicle while consuming alcoholic beverages, or after having consumed alcoholic beverages while there is physical evidence of the consumption present in the person's body.
In other words, Minnesota is a “zero tolerance” state. That means a person can face criminal charges and penalties if they have even a trace amount (.01 BAC) of alcohol in their body.
Penalties
A conviction for underage drink and drive is a misdemeanor punishable by up to 90 days in jail, a $1,000 fine, or both. Additionally, a person’s driver’s license will be suspended for 30 days or 180 days for a second conviction.
An important note: If a driver, under the age of 21, is found to have a BAC over .08, they will face the more serious DWI/DUI penalties described elsewhere within this website.

It is a crime for any person under the age of 21 to consume any alcoholic beverages. An exception to this law is when the person under 21 consumes an alcoholic beverage in their parent or guardian’s household with consent of their parent or guardian.
Penalties
